Law of the People’s Republic of China on the Hainan Free Trade Port by the Standing Committee of the National People’s Congress (June 10, 2021)

The “Law of the People’s Republic of China on the Hainan Free Trade Port” was passed by the 29th session of the Standing Committee of the 13th National People’s Congress on June 10th. It consists of eight chapters and 57 articles, covering aspects such as trade facilitation, investment facilitation, fiscal and taxation systems, ecological environment protection, industrial development and talent support, comprehensive measures, etc. The key points and the full text are as follows:

01 Granting Hainan greater autonomy in reform

The State Council and its relevant departments shall, in accordance with the actual needs of constructing the Hainan Free Trade Port, promptly authorize or delegate the People’s Government of Hainan Province and its relevant departments to exercise relevant management powers in accordance with the law.

The nation will establish a leadership mechanism for the construction of the Hainan Free Trade Port, overseeing and coordinating major policies and matters pertaining to its development. 02 Granting Hainan certain legislative autonomy

The Hainan Provincial People’s Congress and its Standing Committee may, in accordance with the Hainan Free Trade Port Law, combined with the basic situation and actual needs of the construction of the Hainan Free Trade Port, following the basic principles of the Constitution and laws and administrative regulations, enact regulations on trade, investment, and related management activities within the scope of the Hainan Free Trade Port.

03 Highlighting trade and investment facilitation

The country establishes and improves the system of Hainan Free Trade Port customs supervision special zones with full-island customs clearance operations. Building upon effective law-based supervision, it establishes a system for the free and safe movement of goods, optimizing service trade management measures to achieve trade liberalization and facilitation. Hainan Free Trade Port implements policies to liberalize and facilitate investment, comprehensively implementing a streamlined approval system for investments, improving investment promotion and protection mechanisms, strengthening property rights protection, ensuring fair competition, and fostering an open, transparent, and predictable investment environment.

04 Clarifying tax refunds for mainland goods entering the Hainan Free Trade Port

During the full-island customs clearance operations, value-added tax, consumption tax, vehicle purchase tax, urban maintenance and construction tax, and educational surcharges are consolidated, and sales tax is levied on goods and services at the retail level. After full-island customs clearance operations are implemented, the tax system will be further simplified. Goods entering the Hainan Free Trade Port from the mainland are eligible for refunds of value-added tax and consumption tax as stipulated by the State Council.

05 Enhancing Environmental Protection Measures

We will enhance the assessment and monitoring of the ecological environment, as well as strengthen the system governing property rights and compensated use of natural resources assets. We will advance the development of the national territorial spatial planning system and implement differentiated management of natural ecological spaces. Stringent measures will be taken to protect the marine ecological environment, including the establishment of a comprehensive land-sea coordinated system for ecological preservation, restoration, and pollution prevention and control. We will establish a system of responsibility and evaluation for environmental protection objectives, along with a lifelong accountability mechanism for ecological environmental damage.

06 Establishing Risk Warning and Control Systems

We will establish mechanisms for joint prevention and control of smuggling with other regions, requiring personnel, goods, items, and transport vehicles to pass through designated ports between overseas and the Hainan Free Trade Port, and between the Hainan Free Trade Port and the mainland. We will implement a system for reviewing the security of foreign investment, conducting security reviews of foreign investments that may impact or potentially impact national security. We will establish and improve financial risk prevention and control systems, implement network security grading protection systems, establish systems for preventing and controlling risks associated with personnel movement, and establish monitoring and early warning mechanisms for infectious diseases and sudden public health incidents, as well as prevention and control and treatment mechanisms, to safeguard order and security in areas such as finance, networks and data, personnel movement, and public health.

Law of the People’s Republic of China on the Hainan Free Trade Port

(Passed at the 29th Meeting of the Standing Committee of the Thirteenth National People’s Congress on June 10, 2021).

Chapter 1: General Provisions

Article 1: In order to construct a high-level Hainan Free Trade Port with Chinese characteristics, promote the formation of a new pattern of higher-level reform and opening up, establish a new system of open economy, and promote the stable, healthy, and sustainable development of the socialist market economy, this Law is formulated.

Article 2: The state establishes a Hainan Free Trade Port covering the entire island of Hainan, gradually and in stages, to establish a policy and institutional system for the free trade port, realizing free and convenient trade, investment, cross-border capital flows, personnel entry and exit, transportation, and orderly flow of data security.

The construction and management activities of the Hainan Free Trade Port shall be governed by this Law. In cases where this Law does not provide, relevant provisions of other laws and regulations shall apply.

Article 3: The construction of the Hainan Free Trade Port shall embody Chinese characteristics, draw lessons from international experience, focus on Hainan’s strategic positioning, leverage its advantages, promote reform and innovation, strengthen risk prevention, implement the new development philosophy of innovation, coordination, green, openness, and sharing, adhere to high-quality development, uphold the overall national security concept, prioritize people’s well-being, and achieve economic prosperity, social civilization, ecological liveability, and people’s happiness.

Article 4: The construction of the Hainan Free Trade Port focuses on liberalizing and facilitating trade and investment, supported by the free, orderly, secure, and convenient cross-border flow of various production factors and a modern industrial system. It is safeguarded by special tax arrangements, efficient social governance systems, and a comprehensive legal system. Efforts will be made to continuously optimize the legal, international, and convenient business environment, and to create a fair, unified, and efficient market environment.

Article 5: The Hainan Free Trade Port implements the strictest system of ecological environment protection, adhering to ecological priority and green development, innovating ecological civilization system mechanisms, and constructing a national ecological civilization pilot zone.

Article 6: The state establishes a leadership mechanism for the construction of the Hainan Free Trade Port, coordinating and overseeing major policies and matters related to its development. The relevant departments of the State Council, including the National Development and Reform Commission, the Ministry of Finance, the Ministry of Commerce, the financial regulatory authorities, the customs, and the tax authorities, guide and promote the relevant work of constructing the Hainan Free Trade Port according to their respective responsibilities.

The country will establish an administrative management system adapted to the construction of the Hainan Free Trade Port and innovate regulatory models.

The Hainan Provincial Government shall earnestly fulfil its responsibilities, strengthen organizational leadership, and make every effort to promote all aspects of the construction of the Hainan Free Trade Port.

Article 7: The state supports the development of the Hainan Free Trade Port and supports Hainan Province in exercising its reform autonomy in accordance with central requirements and legal provisions. The State Council and its relevant departments shall, according to the actual needs of the construction of the Hainan Free Trade Port, promptly authorize or entrust the People’s Government of Hainan Province and its relevant departments to exercise relevant management powers in accordance with the law.

Article 8: The Hainan Free Trade Port will establish a comprehensive, scientifically standardized, and effectively operating governance system, promote government institutional reforms and functional transformation, standardize government service standards, strengthen the construction of mechanisms for preventing and resolving social conflicts, enhance the intelligence level of social governance, and improve the system of social governance based on co-building, co-governance, and sharing.

The state promotes administrative division reform and innovation in the Hainan Free Trade Port, optimizing the setup and structure of administrative divisions.

Article 9: The state supports the Hainan Free Trade Port in proactively adapting to the development of international economic and trade rules and the reform trends of the global economic governance system, and actively engages in international exchanges and cooperation.

Article 10: The People’s Congress of Hainan Province and its Standing Committee may, in accordance with this Law, combined with the specific circumstances and actual needs of the construction of the Hainan Free Trade Port, following the basic principles of the Constitution and laws and administrative regulations, enact regulations on trade, investment, and related management activities (hereinafter referred to as Hainan Free Trade Port Regulations), which shall be implemented within the scope of the Hainan Free Trade Port.

The regulations of the Hainan Free Trade Port shall be submitted to the Standing Committee of the National People’s Congress and the State Council for the record. If there are any provisions deviating from laws or administrative regulations, the circumstances and reasons for the deviation shall be explained.

For regulations of the Hainan Free Trade Port that involve matters which should be stipulated by the National People’s Congress and its Standing Committee through legislation, or by the State Council through administrative regulations according to law, they shall come into effect only after being approved respectively by the Standing Committee of the National People’s Congress or the State Council.

Chapter 2: Trade Facilitation

Article 11: The state will establish and improve the system of Hainan Free Trade Port customs supervision special zones with full-island customs clearance operations. Building upon effective law-based supervision, it will establish a system for the free and safe movement of goods, optimizing service trade management measures, and achieving trade liberalization and facilitation.

Article 12: The Hainan Free Trade Port shall construct port infrastructure to high standards, strengthen the control of port public health, national border biosecurity, food safety, and product quality security.

Article 13: Goods and items can freely enter and exit between overseas and the Hainan Free Trade Port, subject to customs supervision, except those listed in the prohibition or restriction list of imports and exports for the Hainan Free Trade Port.

The list mentioned in the preceding paragraph shall be formulated by the competent department of commerce of the State Council in conjunction with relevant departments of the State Council and Hainan Province.

Article 14: Goods entering other areas within the territory from the Hainan Free Trade Port (hereinafter referred to as the mainland) are generally subject to import procedures. Items entering the mainland from the Hainan Free Trade Port shall be regulated as stipulated. Import management for transportation vehicles departing from the Hainan Free Trade Port to the mainland shall be simplified.

Goods, items, and transportation vehicles entering the Hainan Free Trade Port from the mainland shall be managed in accordance with domestic circulation regulations.Top of Form

The specific measures for the entry and exit of goods, items, and transportation vehicles between the Hainan Free Trade Port and the mainland shall be jointly formulated by the relevant departments of the State Council in conjunction with Hainan Province.

Article 15: All types of market entities are free to engage in goods trading and related activities within the Hainan Free Trade Port in accordance with the law, and customs shall implement low-intervention, high-efficiency supervision.

With the prerequisite of complying with environmental protection, safety production, and other requirements, the Hainan Free Trade Port imposes no storage period on import and export goods, and allows for the free selection of storage locations for goods.

Article 16: The Hainan Free Trade Port shall implement a policy of customs facilitation, simplifying the procedures and processes for the circulation of goods. Except for goods that require inspection and quarantine or permit management according to law, customs shall release goods entering the Hainan Free Trade Port in accordance with relevant regulations, providing customs clearance facilitation services to market entities.

Article 17: The Hainan Free Trade Port shall adopt a negative list management system for cross-border trade in services and implement corresponding systems for fund payment and transfer. Cross-border trade in services outside the negative list shall be managed according to the principle of consistency between domestic and foreign services.

The negative list for cross-border trade in services in the Hainan Free Trade Port is formulated by the competent department of commerce of the State Council in conjunction with relevant departments of the State Council and Hainan Province.

Chapter 3: Facilitation of Investment Freedom

Article 18: The Hainan Free Trade Port implements a policy of liberalization and facilitation of investment, fully implements a simplified approval system for investment, has improved the system for promoting investment and protecting investment, strengthened property rights protection, ensures fair competition, and has created an open, transparent, and predictable investment environment.

The Hainan Free Trade Port has fully opened investment access, with exceptions for areas where national security, social stability, ecological protection red lines, significant public interests, and other national interests are subject to access management.

Article 19: The Hainan Free Trade Port adopts a system of pre-entry national treatment plus negative list management for foreign investment. The negative list for foreign investment admission in the Hainan Free Trade Port, which is specially applicable, shall be formulated by relevant departments of the State Council in conjunction with Hainan Province, and shall be released after approval by the State Council.

Article 20: The state shall relax market access in the Hainan Free Trade Port. The special market access list (special measures) for the Hainan Free Trade Port shall be formulated by relevant departments of the State Council in conjunction with Hainan Province.

The Hainan Free Trade Port shall implement investment facilitation measures focusing on process supervision, gradually implementing the commitment-to-entry system for market access. Specific measures shall be formulated by Hainan Province in conjunction with relevant departments of the State Council.

Article 21: The Hainan Free Trade Port shall simplify procedures, enhance efficiency, and optimize government services based on the principles of convenience, efficiency, and transparency. It shall establish systems for the convenient establishment, operation, and deregistration of market entities, and optimize bankruptcy procedures. Specific measures shall be formulated by the People’s Congress of Hainan Province and its Standing Committee.

Article 22: The state shall protect the investment, income, and other legitimate rights and interests of natural persons, legal persons, and unincorporated organizations in the Hainan Free Trade Port in accordance with the law, and strengthen the protection of small and medium-sized investors.

Article 23: The state shall protect the intellectual property rights of natural persons, legal persons, and unincorporated organizations in the Hainan Free Trade Port in accordance with the law, promote the improvement of service capabilities in intellectual property creation, utilization, and management, establish and improve mechanisms for credit-based supervision and punishment for intellectual property rights in the field, and strictly hold accountable for intellectual property infringement in accordance with the law.

Article 24: The Hainan Free Trade Port shall establish a unified, open, and orderly market system, strengthen the fundamental position of competition policy, implement a system of fair competition review, enhance and improve the enforcement of anti-monopoly and anti-unfair competition laws, and protect fair competition in the market.

All types of market entities in the Hainan Free Trade Port shall enjoy equal treatment in terms of admission permits, operation and management, factor acquisition, standard setting, preferential policies, etc. Specific measures shall be formulated by the People’s Congress of Hainan Province and its Standing Committee.

Chapter 4: Fiscal and Tax System

Article 25: During the development and construction phase of the Hainan Free Trade Port, the central government finances shall provide appropriate financial support to the Hainan Free Trade Port based on actual circumstances and in conjunction with changes in the tax system. Hainan Province is encouraged to issue local government bonds within the approved quota by the State Council to support the construction of projects in the Hainan Free Trade Port. Hainan Province shall establish a government-guided and market-operated investment fund for the construction of the Hainan Free Trade Port.

Article 26: The Hainan Free Trade Port may, according to development needs, autonomously reduce, exempt, or defer the collection of government funds, except those with ecological compensation nature.

Article 27: In accordance with the principles of a simple and scientific tax structure, comprehensive optimization of tax elements, significant reduction in tax burden, clear income attribution, and basic balance of fiscal revenue and expenditure, and in conjunction with the direction of national tax system reform, a tax system suitable for the needs of the Hainan Free Trade Port shall be established.

During the operation of island-wide customs closure, value-added tax, consumption tax, vehicle purchase tax, urban maintenance and construction tax, as well as educational surcharges, will be consolidated, and sales tax will be levied at the point of goods and service retail. After the island-wide customs closure operation, the tax system will be further simplified.

The financial departments of the State Council, in conjunction with relevant departments of the State Council and Hainan Province, will promptly propose specific plans for simplifying the tax system.

Article 28: After the island-wide customs closure operation and the consolidation of the tax system, the Hainan Free Trade Port shall implement catalogue management for imported taxable goods. Goods outside the catalogue entering the Hainan Free Trade Port shall be exempt from import duties. The catalogue of imported taxable goods shall be formulated by the financial departments of the State Council in conjunction with relevant departments of the State Council and Hainan Province.

Before the island-wide customs closure operation and the consolidation of the tax system, certain imported goods are exempt from import duties, value-added tax, and consumption tax.

For taxable goods exported from the Hainan Free Trade Port, export duties shall be levied.

Article 29: Goods entering the mainland from the Hainan Free Trade Port are generally subject to import taxation. However, for goods produced by industries encouraged by the government, which do not contain imported components or contain imported components that have undergone a certain level of value-added processing in the Hainan Free Trade Port, import duties shall be exempted. Specific measures shall be formulated by the relevant departments of the State Council in conjunction with Hainan Province.

Goods entering the Hainan Free Trade Port from the mainland shall be refunded the value-added tax and consumption tax already levied in accordance with relevant regulations of the State Council.

Before the island-wide customs closure operation and the consolidation of the tax system, duty-free items purchased by outbound travellers and taken off the island are exempt from import duties, value-added tax, and consumption tax according to relevant regulations.

After the island-wide customs closure operation and the consolidation of the tax system, the tax management measures for goods entering and leaving between the Hainan Free Trade Port and the mainland shall be formulated by the relevant departments of the State Council in conjunction with Hainan Province.

Article 30: Enterprises registered in the Hainan Free Trade Port that meet the conditions shall enjoy preferential corporate income tax treatment, while individuals meeting the conditions within the Hainan Free Trade Port shall enjoy preferential individual income tax treatment.

Article 31: The Hainan Free Trade Port shall establish an optimized, efficient, and unified tax administration service system to enhance the scientific, informational, international, and citizen-friendly levels of tax administration services. It shall actively participate in international tax administration cooperation, improve the quality and efficiency of tax administration services, and protect the legitimate rights and interests of taxpayers.

Chapter V: Ecological Environment Protection

Article 32: The Hainan Free Trade Port shall establish a sound ecological environment assessment and monitoring system, formulate a list of ecological environment access, prevent pollution, and protect the ecological environment. It shall also improve the system of property rights for natural resources and the system of compensated use to promote efficient and sustainable use of resources.

Article 33: The Hainan Free Trade Port shall promote the construction of a national territorial spatial planning system, implement differentiated control over the use of natural ecological space, strictly observe ecological protection red lines, construct a natural protected area system with national parks as the mainstay, and promote green urbanization and the construction of beautiful rural areas.

The Hainan Free Trade Port shall strictly protect the marine ecological environment and establish a comprehensive land-sea coordinated ecological system protection, restoration, and pollution prevention and control mechanism.

Article 34: The Hainan Free Trade Port shall implement a strict system of environmental safety access controls for entry and exit, strengthen the construction of inspection and quarantine capabilities, prevent the invasion of foreign species, prohibit the import of solid waste from overseas, enhance the disposal capacity of hazardous waste such as medical waste, improve emergency preparedness and response capabilities for sudden ecological environmental events, and strengthen ecological risk prevention and control.

Article 35: The Hainan Free Trade Port shall promote the establishment of a government-led, enterprise and social participation, market-oriented, and sustainable ecological protection compensation mechanism, establish a mechanism for realizing the value of ecological products, encourage the use of market mechanisms to promote ecological environmental protection, and achieve sustainable development.

Article 36: The Hainan Free Trade Port shall implement a system of responsibility for environmental protection goals and assessment. Local governments at the county level and above are responsible for the annual assessment of departments and their leaders responsible for environmental supervision and management at their level, as well as leaders of lower-level governments, with a veto power based on the completion of environmental protection goals.

Article 37: In areas where environmental protection goals are not met, the approval of environmental impact assessment documents for new construction projects that involve additional emissions of key pollutants in that area will be suspended for one year. The main responsible persons of the local people’s government and departments responsible for environmental supervision and management may not be promoted, appointed, or transferred to important positions within one year, and shall be disciplined according to law.

Article 38: The Hainan Free Trade Port shall implement a lifelong accountability system for ecological and environmental damage. Local governments and relevant departments, as well as the main responsible persons, directly responsible leaders, and other directly responsible personnel who violate the requirements of scientific development and cause serious damage to the ecological environment, shall be held strictly accountable.

Chapter VI: Industrial Development and Talent Support

Article 38: The state shall support the construction of an open, ecological, and service-oriented industrial system in the Hainan Free Trade Port, actively developing key industries such as tourism, modern services, high-tech industries, and efficient tropical agriculture.

Article 39: The Hainan Free Trade Port shall promote the construction of an international tourism consumption centre, facilitating the deep integration of tourism with culture, sports, health care, and elderly care, fostering new formats and models in tourism.

Article 40: The Hainan Free Trade Port shall deepen the opening-up of modern service industries domestically and internationally, establish an international shipping hub, promoting the integrated development of ports, industries, and cities, improve marine service infrastructure, and construct an internationally competitive marine service system.

Overseas high-level universities and vocational colleges can establish schools specializing in science, engineering, agriculture, and medicine in the Hainan Free Trade Port.

Article 41: The state supports the construction of major scientific research infrastructure and facilities in the Hainan Free Trade Port, establishing a scientific and technological innovation management system and international scientific and technological cooperation mechanisms in line with scientific research principles.

Article 42: The Hainan Free Trade Port shall establish a management system for the safe, orderly, free, and convenient flow of data in accordance with the law, protect the rights and interests of individuals and organizations related to data, expand the opening of communication resources and services in an orderly manner, expand openness in the field of data, and promote the development of the digital economy with data as a key element.

The state supports the exploration and implementation of regional international data cross-border flow arrangements in the Hainan Free Trade Port.

Article 43: The Hainan Free Trade Port shall implement highly free, convenient, and open transport policies, establish a more open shipping system and vessel management system, construct the “China Yangpu Port” as a flag port, and implement a special ship registration system. It shall relax airspace control and route restrictions, optimize the allocation of air rights resources, and improve transportation facilitation and service guarantee levels.

Article 44: The Hainan Free Trade Port shall deepen the reform of the talent development system and mechanism, innovate the mechanism to support talent cultivation, and establish a scientifically reasonable mechanism for talent introduction, recognition, utilization, and treatment guarantee.

Article 45: The Hainan Free Trade Port shall establish an efficient and convenient entry-exit management system, gradually implement a more widely applicable visa-free entry policy, extend the visa-free stay period, optimize exit-entry inspection management, and provide convenience for entry and exit clearance.

Article 46: The Hainan Free Trade Port shall implement more open policies for talent attraction and residence, adopt more relaxed temporary entry-exit policies for individuals, and facilitate work visa policies. It shall implement a negative list management system for work permits for foreigners and further improve the residence system.

Article 47: The Hainan Free Trade Port shall relax restrictions on overseas personnel participating in professional qualification examinations and adopt a unilateral recognition list system for the recognition of overseas professional qualifications that meet the conditions.

Chapter VII: Comprehensive Measures

Article 48: The State Council may authorize the People’s Government of Hainan Province to approve matters related to the conversion of agricultural land to construction land and land expropriation that are subject to State Council approval according to the needs of the construction of the Hainan Free Trade Port.

The State Council may authorize the People’s Government of Hainan Province to approve the adjustment of the layout of cultivated land, permanent basic farmland, forest land, and construction land in the province in accordance with the conditions specified by the state, provided that it does not exceed the important indicators such as the ecological protection red line, the area of permanent basic farmland, the total area of cultivated land and forest land, and ensure that the quality is not reduced.

Hainan Free Trade Port actively promotes the integrated development of urban and rural areas, reclaimed areas, and the establishment of a new model for land use in small towns, advancing the assetization of agricultural reclaimed land.

According to the law, it safeguards the demand for sea use of major national projects in the Hainan Free Trade Port.

Article 49: The construction of the Hainan Free Trade Port shall effectively protect farmland, strengthen land management, establish a system of intensive and economical land use, evaluation standards, and a system for the revitalization and disposal of existing construction land. Fully utilizing idle land, for land acquired through transfer for development that exceeds the completion date stipulated in the transfer contract by one year, a certain proportion of the current land value idle fee shall be levied annually before completion. Specific measures shall be formulated by the Hainan Provincial Government.

Article 50: The Hainan Free Trade Port shall adhere to providing financial services to the real economy, advancing financial reform and innovation, and taking the lead in implementing open policies in the financial sector.

Article 51: The Hainan Free Trade Port shall establish a cross-border fund flow management system that meets the needs of high-level trade and investment liberalization and facilitation, gradually open up capital projects in stages, progressively promotes full convertibility under the non-financial corporate debt category, facilitate cross-border trade settlement, and orderly promote the free and convenient flow of funds between the Hainan Free Trade Port and overseas.

Article 52: Approved financial institutions within the Hainan Free Trade Port can conduct offshore financial services through designated accounts or operate in specific areas.

Article 53: The Hainan Free Trade Port shall strengthen the construction and application of the social credit system, establishing mechanisms for rewarding trustworthiness and punishing dishonesty.

Article 54: The nation supports exploring judicial system reforms adapted to the Hainan Free Trade Port. The Hainan Free Trade Port shall establish a diversified mechanism for resolving commercial disputes, improve mechanisms for centralized adjudication of international commercial disputes, and support the resolution of disputes through various non-litigation methods such as arbitration and mediation.

Article 55: The Hainan Free Trade Port shall establish a risk warning and control system to prevent and mitigate major risks.

Customs are responsible for routine supervision at ports and other customs-controlled areas, conducting lawful smuggling investigations, and implementing subsequent supervision.

Maritime law enforcement agencies are responsible for investigating illegal maritime smuggling activities. The Hainan Provincial People’s Government is responsible for comprehensive anti-smuggling governance in the province, strengthening control over non-customs areas, and establishing joint prevention and control mechanisms with other regions to combat smuggling.

Personnel, goods, items, and transportation vehicles must enter and exit through designated ports between overseas and the Hainan Free Trade Port, as well as between the Hainan Free Trade Port and the mainland.

The Hainan Free Trade Port shall implement a system for reviewing the national security implications of foreign investment in accordance with the law, and conducting security reviews of foreign investments that affect or may affect national security.

The Hainan Free Trade Port shall establish and improv financial risk prevention and control systems, implement a network security grade protection system, establish a system for preventing and controlling personnel mobility risks, establish monitoring and early warning mechanisms for infectious diseases and public health emergencies, and ensure order and security in areas such as finance, network and data, personnel mobility, and public health.

Chapter VIII: Supplementary Provisions

Article 56: For matters stipulated in this law, after the implementation of this law, before the island-wide closure operation of the Hainan Free Trade Port, the State Council and its relevant departments, together with Hainan Province, may, in accordance with the principles stipulated in this law and based on their respective responsibilities, formulate transitional specific measures to promote the construction of the Hainan Free Trade Port.

Article 57: This law shall come into effect on the date of its promulgation.
